Pursuant to
the Ministry of Planning and Investment (MPI)’s guidelines
regarding investment licence re-registration, conversion, and
conversion registration timeline of foreign-invested
enterprises (FDI) and/or Business Cooperation Contract (BCC)
according to the Enterprise Law and Investment Law 2005; and
MPI’s guidelines regarding conducting Government Resolution
No. 06/2008/NQ-CP dated March 3rd, 2008 for the purpose of
resolving resolve obstacles to enhance the implementation
process of FDI projects in Vietnam, Ho Chi Minh City -
Department of Planning and Investment (HCMC – DPI) hereby
announces as follows:
1. The deadline for re-registration is due on
July 1st, 2008, as stipulated in Item a, Provision
2, Article 170 of the Enterprise Law.
2. The rights and obligations of re-registered foreign
invested enterprises are stipulated in Article 9 of Decree No.
101/2006/NĐ-CP dated September 21th, 2006, issued by the
Government, regarding the investment licence re-registration,
conversion and conversion registration of foreign-invested
enterprises in accordance to the Enterprise Law and Investment
Law.
3. As stipulated in Item b, Provision 2, Article 170 of the
Enterprise Law, failure to re-register means an enterprise is
to comply with the business scope and duration of operation
certified in its investment license and continues to be
eligible for investment incentives as stipulated by the
Government.
4. The procedures and dossiers required for re-registration
are stipulated in Article 7, Decree No. 101/2006/NĐ-CP dated
September 21th, 2006 issued by the Government.
5. To support and resolve difficulties encountered by FDI
enterprises in their operation, DPI proposes that FDI
enterprises and/or BCC submit a form including information on
the progress of investment projects and feedback for the
purpose of statistics and administrative reforms in Ho Chi
Minh City.
Please access the Information form, fill in the
relevant information and submit it to HCMC – DPI, Division of
Foreign-Invested Enterprises, at 32 Le Thanh Ton St., Ben Nghe
Ward, Dist. 1, HCMC. Soft-copies of “Information Form on
Progress of Investment Projects by [name of company]” are
required to email to
ipdpi@hcm.vnn.vn for reference. The deadline for
submitting this form to HCMC – DPI is prior to June
30th, 2008.
